Definitions 

When we say "we," "us," "our," "BASA" or "Bookastreetartist"  we are referring to BASA Studio GmBH. We are dedicated to empowering artists and making their art universally accessible for anyone to book them. We believe that talent should be valued independently from the context it is presented in. We do this by building and maintaining our platform that matches "you", by whom we mean Users/Visitors in the form of Artists wanting to offer their services as well as Clients looking to find talented Artists for their perfect moments. This matching and managing of moments are what we will refer to as "Service". 



Infomation we collect 

The BASA platform collects information, including personal information such as full name, email addresses and other contact details. When we say "Personal information" we mean information that either alone or in combination with other info can identify you as an individual. 

Infomation collected from Visitors

From a Visitor, we collect potentially personally-identifying information like Internet Protocol (or “IP”) addresses (“Potential PII”). Also, you may choose to interact with the site in ways that result in your providing personal information to us, such as giving us your name, phone number, email address or username and password when signing up as an Artist or when sending an inquiry. 
We make sure only to collect Personal Information that is reasonable or necessary to accomplish and develop the purpose of your interaction with the platform as a Visitor. You may choose not to provide this information but you need to understand that as a result, you may not be able to engage in certain activities on the site. 
As a Visitor, the data we store on you is of un-personal nature, and we only store it to help us gain a better understanding of our platform. This data is aggregated by our analytics processor and kept for 3 months before being deleted. 


Information collected from Clients

We may store information on your behalf, this includes information like postal address, phone number, company name and credit card payment information. 
We may receive, process and store information about how you interact with our platform and the ways you use our Services. In order to help us improve our Services for you and our other Users and Artists, we may link it to other information we collect about you. This information may include, for example, your IP address, time, date, browser used, and actions you have taken within the application. 
We may also send e-mails about our site or respond to inquiries, of which you as a Client can opt out at any time, feel free to contact us about this at [email protected].
We will store this data on you as a Client as long as you remain in the process of booking an Artist with us. This means from the moment you send an inquiry until you either find the perfect Artist for you or choose to stop the process. Either way your data will be removed as such after 30 days.  


Information collected from Artists 

We collect your first and last name, email address, phone number, location and password when you create an account to log in to our platform as an Artist (“Account”).
We may receive, process and store information about how you interact with our platform and we may store it in association with your Account. To help us develop our platform we may link it to other information we collect about you, like how you behave with the tools we create for you. This information may include, for example, your IP address, time, date, browser used, and actions you have taken within the application. This type of information helps us to improve our Services for both you and for all of our Users.
We may also send e-mails about our site or respond to inquiries, of which you as an Artist can opt out at any time, feel free to contact us about this at [email protected].
We will store this necessary data on you as long as you use our Services if you ever choose to leave us we will delete your profile and services along with any data we have stored on you within 30 days. 

Cookies and tracking

Bookastreetartist and our partner services such as Google may collect certain information during your time on our platform via "cookies" or similar technologies like reCAPTCHA which are dictated the Google Privacy Policy and their Terms of Use (https://www.google.com/intl/en/policies/privacy/, https://www.google.com/intl/en/policies/terms/). These cookies have the important function to deliver us the information we use to better our Services by delivering us valuable data on, for example, demographics, count of visitors to our site and places within the site that are popular. Most web browsers tend to accept these cookies by default, but if you would like to not be tracked by these you can switch them off via your browser settings. If you choose to remove the tracking function of these cookies it will affect certain features and Services on our site. 

Use of your Personal Information

  • To improve our platform, Services, features and tools and how we operate as a platform;
  • To help us understand you which enables us to enhance your experience on our platform;
  • To facilitate the creation and securing of your profile on our network;
  • To identify you as a User within our system;
  • To provide the products and services that you request;
  • To aid our support team so that they can respond to your comments or questions;
  • To send you important information such as confirmations, invoices, technical notices, updates, security alerts and support and administrative messages;
  • To help us link or combine it with information we get from third parties, that help us understand your needs and provide you with better service; and
  • To protect, investigate and deter against unauthorized or illegal activity. 


The release of your Information

 Let's start this off by saying that we will never sell your data to third parties. However, because of the nature of our business, we may hire third party individuals and/or organizations that aid us in making the platform and its features better for you. When we say third party individuals and/or organizations we mean for example our web host provider, other SaaS providers, such as an email hosting service, payment processors or outside contractors that we hire to perform maintenance or assist us in securing our website. These third-party service providers also assist us in operating, maintaining, repairing, and otherwise improving or preserving our website and its underlying files or systems.

If we are required to do so we will hand out access or release Personal Information about you in order to comply with any applicable laws, regulations, subpoena or enforceable governmental or public authority request, including to meet national security or law enforcement requirements. If we have good faith and strongly believe that the release of your data is necessary we may also access or release Personal Information, this will only be considered in cases such as (i) to enforce applicable terms of service, including investigation of potential violations, (ii) to detect, prevent, or otherwise address fraud, security or technical issues, (iii) to respond to User support requests, or (iv) to protect our rights, property or safety, our Users and the public. This includes the exchanging of information with other companies and organizations for fraud protection and spam/malware prevent.


Public information and third party websites 

We do have a blog, a public one at that. Any information that you include in a comment on any of our posts on our blog may be read, collected, and used by anyone else. If your Personal Information appears on our blogs and you want it removed, contact us at [email protected] we will get back to you as soon as we can. 

We have links to third party websites on our site. When you activate these links you may be brought to these third party websites and it needs to be noted that their privacy practices may be different from ours and you should inform yourself about them. If you submit Personal Information to any of those sites, your information is governed by their privacy policies. Which is again why we strongly recommend reading the rules and regulations of any site you visit. 

Personal Information security

We invest a lot of effort to maintain commercially reasonable administrative, technical, and physical safeguards that protect your Personal Information in order to prevent loss, misuse, and unauthorized access, disclosure, alteration and destruction of your data. These measures include for example using SSL Certificates and two-factor authentification. However, the Internet is like the Wild West and no transmission is 100% secure thus we cannot promise that the information about you will remain secure in all circumstances. This is why it is also your responsibility to protect your data to help prevent anyone with ill intent to access and abuse your accounts and Services. One of the easiest ways of doing so is to not reuse the same passwords you use with other accounts as your password for our Services.

Notice of breach of security

If we ever do notice an unauthorized security breach into our system that affects you in ways such as the loss of your data or the theft of it we will notify you as soon as possible as well as the responsible authorities and report on the actions we took in response.


Children

We do not and try our best not to intentionally gather Personal Information of visitors on our site that are under the age of 16. If you are under the age of 16, we want to clearly state that you are not permitted to submit any Personal Information to us. If we learn that a child under 16 submits Personal Information or if you believe that we might have stored Personal Information on a child under 16 please contact us under [email protected]and we will immediately attempt to delete the information.


Your Infomation choices and changes 

We firmly believe and support that you and all our Users have a right to access their Personal Information that we store about you. Whenever you are using our site and its features, we want to make sure that the Personal Information you deliver to us is correct. If that information is ever wrong, we want to give you the option to correct, update, pause or delete it, that is unless we have to keep this data due to a legitimate business or legal purpose. If you ever do want to make changes or update your Personal Information, we may ask you to verify that it is really you via personal identification. We may reject certain unreasonable types of requests that are for example repetitive spams, require disproportionate technical effort (for example, developing a new system or fundamentally changing an existing practice), those that risk the privacy of others, or would be extremely impractical. Whenever we can provide information access and or correction for you, we will do so for free, always. Because we put such care into protecting information from accidental or ill-intended destruction, even after the information is deleted from the platform, it may not be immediately deleted from our servers.

Changes to this Policy

We here at Bookastreetartist may change this Policy from time to time but don't worry if we do we will make sure to let you know. either via a notice on our homepage or we may send a notice to you directly. We will let you know what changes we have made and from what point onward they will be effective. We purposely try to write this legal text as simplistic as possible so that you may not shy away from periodically reviewing this text to understand our privacy practices. 

One more thing:

If you are considering opting-out, we want to make sure that you really understand the immense purpose that your data has for us. We are not evil, and we use the data we collect only to make our platform and our tools better for you.

We have no other intentions aside from bettering our platform to empower our artists and make their work universally accessible. This service is emphatically not one of those we-track-you-around-the-web kind of deals. We think that's creepy, too.

Honesty we are just like anyone else: we are a group of cool people that want to promote art and make something awesome happen. And you wouldn't believe how much time and energy our teams put into trying to make our website great for you. Without these tracking and data collection Services, we simply would not have enough information to understand what we are doing wrong, or could be doing better. If we can see how you and our users actually experience our website, over a longer period of time,  we begin to actually understand what to improve! Most of the time we really don't need to record anything sensitive in order to do this, but sometimes, for the simple process of this site, like sending an inquiry we do. We just want you to know that we give our very best to treat your data respectfully and protect it from those that have an ill intent.
